Welcome to the Ahfy Beta Test! These Terms and Conditions of Use
(“Terms”) govern your participation in the beta testing program for
Ahfy, a mental health and emotional wellness platform operated by
B.C.S., located at 413 Chemin de la Roumiguière, 13360 Roquevaire,
France (“we,” “us,” or “our”). By accessing or using Ahfy during the
beta testing period, you agree to comply with these Terms. Please read
them carefully before proceeding.
1. Beta Testing Agreement

You understand that Ahfy is currently in the beta testing phase and
may contain errors, bugs, or other defects. You agree to participate
in the beta testing program and use Ahfy at your own risk.

You acknowledge and agree that Ahfy may not function correctly or
produce the desired results during the beta-testing phase.

You agree to provide feedback, including reporting any errors or
issues you encounter using Ahfy, to help us improve the system. Any
feedback you provide may be used by us for further development without
any obligation to compensate you.
2. Use of Ahfy

You must be at least 18 years old to participate in the Ahfy beta
testing program. If you are under 18 years old, you must obtain
consent from your parent or legal guardian.

You agree to use Ahfy only for its intended purpose: emotional
wellness support and personal development.

You will not use Ahfy for any illegal, fraudulent, or unauthorized
purposes.

You will not attempt to gain unauthorized access to Ahfy’s systems or
interfere with its functionality.

You will not use Ahfy to transmit any unlawful, harmful, defamatory,
obscene, or otherwise objectionable content.

You understand and agree that Ahfy’s performance may vary depending on
factors such as internet connection quality, device compatibility, and
system requirements.

You will not share your Ahfy access or login details with anyone.
3. Privacy and Data Protection

We may collect and process personal information as part of the beta
testing program. By participating in the Ahfy beta test, you consent
to the collection, use, and processing of your personal information in
accordance with our Privacy Policy.

You acknowledge that during the beta testing period, we may collect
additional data, including usage information, system logs, and error
reports, to diagnose and address issues and improve Ahfy’s
performance.

We will take reasonable measures to protect your personal information,
but we cannot guarantee the security of data transmitted over the
internet.
4. Intellectual Property

All intellectual property rights, including copyrights, trademarks,
and patents, in Ahfy and its associated materials belong to us or our
licensors. You acknowledge and agree that you do not acquire any
ownership rights in Ahfy or its intellectual property.

You will not copy, modify, distribute, sell, or create derivative
works based on Ahfy or any of its components unless authorised by us.
5. Disclaimer of Warranties

Ahfy is provided “as is” and without warranties of any kind, whether
express or implied. We do not warrant that Ahfy will be error-free,
uninterrupted, or free from viruses or other harmful components.

We disclaim any liability or responsibility for any loss, injury, or
damage arising from or related to your use of Ahfy, including but not
limited to any errors, bugs, or inaccuracies in its functionality.
6. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any
direct, indirect, incidental, consequential, or special damages
arising out of or in connection with the use of Ahfy, even if we have
been advised of the possibility of such damages.

In jurisdictions where limitations of liability are not allowed, our
liability shall be limited to the fullest extent permitted by
applicable law.
7. Termination
We reserve the right to terminate or suspend your participation in the
Ahfy beta testing program at any time, for any reason, without prior
notice.
8. Modifications to Terms
We may modify these Terms at any time by posting the revised version on
the Ahfy website or by notifying you through other reasonable means.
Your continued use of Ahfy after any such modification constitutes your
acceptance of the revised Terms.
9. Governing Law
These Terms shall be governed by and construed in accordance with the
laws of France, without regard to its conflict of law provisions.
10. Entire Agreement
These Terms constitute the entire agreement between you and us regarding
your participation in the Ahfy beta testing program and supersede all
prior agreements and understandings.
